“Shooter” to be prosecuted after Private Prosecution Unit becomes involved

Dennis Hearn is being prosecuted for the murder of Nicky Botes after he allegedly shot the deceased in the head during a road rage incident in Klerksdorp in June this year. This follows after the father of Botes approached AfriForum’s Private Prosecution Unit because it seemed that there had been no progress in the case and the SAPS failed to provide him with significant feedback. Hearn had not even been arrested until the Private Prosecution Unit became involved.

Investigators at AfriForum’s Private Prosecution Unit brought the case and the apparent lack of progress in the investigation to the attention of the senior prosecutor of the National Prosecuting Authority (NPA) in Klerksdorp and consulted with him about the case. The prosecutor thereafter requested that the police provide him with the docket. After perusing the docket, he gave the instruction that Hearn had to be prosecuted immediately. Hearn appeared in the Klerksdorp Magistrate’s Court for the first time on 8 December 2021 and the trial is expected to start next year.

“The decisive action taken by the prosecutor in this case is commendable. It is, however, concerning that the Private Prosecution Unit had to become involved in a straightforward case such as this one to ensure that the wheels of justice would start turning. The victim and his family deserve justice and the accused must be held accountable. We will therefore continue to support the family and monitor the progress of the case,” says Natasha Venter, Advisor at AfriForum’s Private Prosecution Unit.
