Delay tactics again implemented in case against EFF leader

EFF leader Julius Malema’s legal team again today relied on delay tactics in an attempt to postpone justice. Malema and his bodyguard Adriaan Snyman, are currently on trial in the East London Regional Court following charges laid by AfriForum. These charges were laid after a video emerged of the politician appearing to discharge a rifle in public – the rifle was handed to Malema by Snyman.

The National Prosecuting Authority (NPA) is prosecuting Malema for the discharge of a firearm in a built-up or public area without good reason to do so, as well as the possession of a firearm and ammunition without the necessary licence and authorisation.

Malema’s legal team today indicated that they will file an application to have magistrate T. Olivier recused from the case. This followed an outburst by Malema from the dock, claiming that magistrate Olivier was prosecuting him and Snyman, after she asked one of the state witnesses questions to clarify his testimony.

Yesterday, in another attempt to delay the trial, Malema’s legal team requested a “trial within a trial” to determine whether the video evidence purportedly showing Malema fire the weapon, should be admitted. Magistrate Olivier ruled that the evidence may be admitted.

“This is nothing more than a deliberate abuse of the justice system by unnecessarily delaying the proceedings. If Malema was innocent, his legal team would have surely grabbed the opportunity to prove it. However the video evidence is very clear,” says Jacques Broodryk, AfriForum’s spokesperson for Community Safety.

“We will continue to monitor this case closely, no matter how many times it gets postponed or delayed to ensure that Malema faces the consequences of his actions. Politicians need to be reminded that they are not above the law,” Broodryk concludes.
