Clover-strike: Proceedings postponed; accused persons still in custody

The proceedings in the bail application of Lesiba Mantsi, Ralph Shingange and Melford Rammutla, three of the persons who are being accused of amongst others the murder of Terence Tegg and JJ Cassanga during the Clover-strike in February, was today postponed in the Tembisa Magistrate’s Court to 4 August.

Mantsi’s legal representative today concluded his cross-examination of Capt. Robert Seckle, the investigating officer in the case, whereafter Shingange and Rammutla’s legal representatives both brought an application in terms of section 60 of the Criminal Procedure Act. This application entails that video footage, as well as still images, of the incidents are shown in court. The defense argued that it is necessary that the accused persons and the court see the footage in order to make a just finding.

The court is expected to make a ruling on this application on 4 August whereafter the cross-examination of Seckle by the legal representatives of the other two accused persons will commence.

Mohale Shokane and Nkosinathi Mbatha’s bail applications were dismissed by Magistrate Karien Brits on 19 April. Shokane and Mbatha’s defense team also initially brought an application for the footage to be shown in court, but after consultation with their clients, withdrew these applications.
